Llamamiento global para que se adopten mecanismos internacionales de seguimiento de la situación de los derechos humanos en China

Carta abierta a: Secretario General de la ONU António Guterres, Alta Comisionada de la ONU para los Derechos Humanos Michelle Bachelet, Estados Miembros de la ONU

Las organizaciones que suscriben la presente declaración se unen a fin de solicitar que se establezca un mecanismo internacional para abordar las violaciones de derechos humanos perpetradas por el gobierno de China y para instarlos a que adopten medidas decisivas orientadas a lograr este objetivo.

El 26 de junio de 2020, un total sin precedentes de 50 expertos de las Naciones Unidas exhortaron a que se dispongan “medidas decisivas para proteger las libertades fundamentales en China”. Alertaron sobre las violaciones masivas de los derechos humanos por parte de China en Hong Kong, el Tíbet y Xinjiang, la censura de información en el contexto de la pandemia de Covid-19 y los ataques contra defensores de derechos, periodistas, abogados y críticos del gobierno en todo el país.

Asimismo, a nuestras organizaciones les preocupa el impacto mundial de las violaciones de derechos humanos que comete China. El país ha actuado contra defensores de derechos humanos en el extranjero, ha reprimido la libertad académica en países de todo el mundo y ha realizado acciones de censura en Internet y vigilancia digital. Repudiamos el modo en que China promueve el desarrollo sin reconocimiento de los derechos, y el consiguiente degrado ambiental que provocan las industrias extractivas avaladas por el gobierno, así como el trato racista de personas en China o por parte de actores estatales chinos en otras partes del mundo.

Estamos profundamente consternados por los intentos de China de distorsionar el mandato del Consejo de Derechos Humanos de las Naciones Unidas al promover la “cooperación” por sobre la rendición de cuentas y oponerse a iniciativas orientadas a asegurar el escrutinio de graves violaciones de derechos humanos y crímenes internacionales en países de todo el mundo. China ha usado su asiento en el Comité de la ONU Encargado de las ONG para negar de manera injustificada la acreditación a organizaciones no gubernamentales (ONG) y, al mismo tiempo, acreditar a ONG organizadas por el gobierno (GoNGO, por su siglas en inglés). Ha procurado negar el acceso de los defensores de derechos humanos a sedes de la ONU, ha denunciado como “terroristas” a expositores en actividades paralelas de ONG y ha amenazado a delegados para disuadirlos de asistir a eventos paralelos de la ONU en los que se abordaron violaciones de derechos humanos, incluidos los abusos en Xinjiang.

Cuando la Alta Comisionada de la ONU para los Derechos Humanos, los Procedimientos Especiales y decenas de Estados instaron a China a cumplir con los estándares internacionales de derechos humanos, el país respondió que estos eran “comentarios improcedentes” que suponían una “grave intromisión” en la soberanía de China.

Un Estado que intenta librarse de cualquier tipo de escrutinio supone una amenaza fundamental para los derechos humanos. Que China —un Estado con un inmenso poder global— pretenda recibir ese trato es algo que nos afecta a todos.

Por estos motivos, respaldamos el llamado de los expertos de la ONU a que se celebre un período extraordinario de sesiones del Consejo de Derechos Humanos en el cual se evalúe el espectro de abusos que comete el gobierno de China y para establecer un mecanismo imparcial e independiente de la ONU abocado a realizar un seguimiento y análisis atento del tema y a comunicar sobre esto en forma anual. Exhortamos al Secretario General de la ONU a designar a un Enviado Especial, en forma consecuente con su Llamado a la acción por los derechos humanos, y alentamos a la Alta Comisionada para los Derechos Humanos a dar cumplimiento a su mandato independiente de realizar un seguimiento e informar de manera pública sobre las violaciones generalizadas de derechos humanos perpetradas por China. Apoyamos el reclamo de que los Estados Miembros y los organismos de la ONU utilicen todas las oportunidades de interacción con las autoridades chinas para insistir en que el gobierno cumpla con las obligaciones internacionales de derechos humanos que ha asumido.

Escribimos la presente declaración con ánimo de solidaridad y colaboración global, y los instamos a actuar de inmediato para contrarrestar y remediar las graves violaciones de derechos humanos que cometen las autoridades chinas. Ningún Estado puede estar por encima de la ley.
